TERMS OF USE
Published & effective May 1, 2025. These Terms of Use replace and supersede all prior versions.
Definitions
Participant means any person on whose behalf YOU are enrolling.
"I", "you" means the person signing this form.
“MPOWR Culture”, “we”, “our”, means directors, employees, representatives, volunteers, or affiliates of MPOWR Culture
Terms of Service
Participants cannot move to an advanced class without consent from the player development coach/ director and not until the current program is complete. Classes are based on skill level more than age. Although athletes may qualify by age for a specific class, they may not meet the skill requirement.
Active MPOWR Culture memberships grant you access to exclusive discounts for other programs such as basketball camps and future enrollment.
Participants and guests must adhere to court rules.
Payment
When joining a program, you may enroll in a pricing plan of 3-4 payments. Pricing plans show up as a Subscription and allow you to register for certain classes. You will not receive credits for missed classes. You are financially responsible for the cost of the basketball program once you enroll, regardless of how often your athlete participates.
You authorize MPOWR Culture and our authorized vendor(s) to store your payment method and use it in connection with your use of the Services as described in your Subscription and Cancellation Terms. You may incur fees for disputing authorized charges with your financial institution.
If you mistakenly enroll in the wrong program, you have 24 hours to request a modification. Refunds for overpayment must be requested within 72 hours- fees are excluded. Otherwise, you'll receive a credit that expires in 6 months.
Termination by you
You can cancel your subscription at any time, but fees may apply. Cancellation or termination of your account does not relieve you of any obligation to pay any outstanding fees associated with your subscription, including, but not limited to early cancellation fees.
Termination by MPOWR Culture
We may at any time immediately terminate or suspend your right to use and access if in MPOWR Culture’s sole discretion:
(A) you breach any provision of the Terms (or act in a manner that clearly shows you do not intend to, or are unable to, comply with the Terms);
(B) you fail to make the timely payment of fees for service, if;
(C) you physically, verbally, or through other means abuse, threaten, bully, or harass us or our personnel or other participants
Release of Liability
I understand there is a natural risk of injury, whether caused by the participant or someone else. Despite precautions, accidents and injuries may occur. I understand that the risk of injury includes, but is not limited to:
1. Any accidental or "slip and fall" injuries; and
2. Injuries or medical disorders (such as heart attacks, strokes, heart stress, head injuries, sprains, cuts, bruises, broken bones and torn muscles or ligaments) resulting from Participant's use of equipment or services at MPOWR Culture location, or the Participant’s participation in any MPOWR Culture activities. I understand and voluntarily accept this and all risk on behalf of Participant.
I specifically waive my right and/or Participant’s right to bring or take any action against MPOWR Culture as a result of any injury, loss, theft, or damage to myself and/or Participant, including and without limitation, personal bodily or internal injury, economic loss or any other type of damage, regardless of whether resulting from Our negligence or anyone else.
I agree to defend, indemnify, and hold MPOWR Culture harmless against any claims arising out of the negligence or willful acts or omissions of myself or Participant. I agree to specifically assume all risk of loss, theft or damage of personal property for the Participant while he or she is present at MPOWR Culture location, or participating in any MPOWR Culture related activity.
I specifically acknowledge that, if I am not a parent or legal guardian of the Participant, I have discussed the terms of this Agreement with the Participant’s parent or legal guardian and have been given the authority by the Participant’s parent or legal guardian to sign this Agreement on the Participant’s behalf. Furthermore, I agree to obey the class and facility rules and take full responsibility for my/our behavior in addition to any damage I/we may cause to the facilities utilized by MPOWR Culture.
I approve the use of any pictures that may be taken at MPOWR Culture location, in which the Participant is part of, to be used on any MPOWR Culture website, social, or print media, and marketing advertisements.
Updates to Policy
MPOWR Culture may make changes to the policy Terms over time. If we make any important changes, we will notify you. Please review the Terms regularly. If you do not agree to the amended Terms, you must stop using our service.
COURT RULES
Athletes, parents, and guests must adhere to our court rules
For safety, only athletes training at the moment and staff are allowed on the court. Children are not allowed on the court, even if they're being supervised. Athletes whose class or practice is not in session, are not allowed on the court to shoot around or warm-up, even during break times.
Unless for an emergency, parents and guests are not allowed to interfere with practice, class, or games. This include providing input, attempting to correct, and attempting to reprimand your athlete. Parents and guests are allowed to attend training sessions to watch only. If a parent or guest’s behavior becomes distracting to an athlete, they may be asked to return when class ends.
Please allow your child the space to self-correct. Save reminders for after their practice, class, or game to allow for full focus. Isolation in these moments provide the opportunity to build their mental capacity.
